Florida’s greyhound races unlikely to return anytime soon

Greyhound racing is as iconic to South Florida as are palm trees and pink flamingos. However, things change and the old has to make way for the new. In 2018, Florida voters decided that they no longer needed greyhound races to identify them, choosing to eliminate the activity by next year. The measure, Amendment 13, didn’t sit well with the 11 dog tracks in the state, even though it was the will of the people, and a challenge was launched. Trying to argue that getting rid of the races was unconstitutional didn’t have the desired effect, though, and a federal judge has ruled that the death of greyhound racing will stay on track.

Specifically, the section that deals with illegal seizures of property without fair compensation. They argued that the state was “taking” their property and depriving them of “substantially all economically beneficial or productive use of their property and return on their investments.” However, their argument didn’t hold up to scrutiny.

Greyhound races may be going the way of the dodo bird in Florida, but the venues are able to continue other operations, such as poker rooms, simulcast gambling and, where permitted, slot machines. Additionally, in Florida, gambling is a privilege, not a right.

Florida’s government, which had been named as defendants in the lawsuit, had hoped to see the case thrown out, but that didn’t happen. It was allowed to run its course, and Chief U.S. District Judge Mark Walker issued a 55-page ruling earlier this week to offer his verdict. He explained, “Whether Amendment 13’s purpose was to protect the health and welfare of racing dogs, or to prohibit wagering on dog races, Amendment 13 is a legitimate exercise of Florida’s police power… Accordingly, Amendment 13 does not constitute a compensable taking under the Fifth Amendment.”

Perhaps feeling that their unconstitutionality claims might not find the support they hoped for, the plaintiffs in the lawsuit, Support Working Animals Inc. and industry stakeholders, threw in another argument. They asserted that Amendment 13 violated their equal protection rights because the state hadn’t made a similar plan to get rid of horse racing. This also fell short since the amendment “does not involve suspect classes such as race, gender, or national origin,” according to the judge.

The coronavirus may have forced up the timetable of the demise of greyhound races in the Sunshine State. The current pandemic has already forced the tracks to halt their activities, and they may decide that it isn’t worth it to try to relaunch them for what would amount to only about six months of potential races.

Hard Rock Gets Five-Month Deadline Extension for Spain Casino Resort Land Acquisition

The Government of Catalonia this week granted extension of the deadline for the acquisition of the portion of land where US casino and hospitality operator Hard Rock International plans to build a €2 billion integrated resort.

In 2017, Hard Rock won the right to develop a mega-resort in the Tourist Recreation Center of Vila-seca and Salou (in the Catalan province of Tarragona), right next PortAventura Park.

However, the project has over the years hit a number of snags, mostly related to the acquisition of land for the proposed multi-purpose resort.

Hard Rock finally worked out a deal with the Government of Catalonia in March, under the terms of which state-run company Incasòl would buy the land designated for the resort from its current owner – Spanish investment giant La Caixa – for €120 million. Incasòl would then sell the land to Hard Rock for the same price.

The US casino and hospitality operator had until May 5 to close the land acquisition arrangement. However, the company asked for five-month extension of that deadline as the shutdown of its properties due to the coronavirus pandemic has been eating into its profits.

As mentioned above, the Catalan government has agreed to grant the requested five-month extension. Hard Rock now has until October 5 to complete the transaction.

The Hard Rock Entertainment World Project

Hard Rock Entertainment World will be a mega-resort with multiple attractions, hotels, food and beverage facilities, and a casino. The property will be Hard Rock’s first hotel and casino complex in Europe.

As mentioned earlier, the company plans to spend €2 billion on the scheme. That price tag includes construction costs, land acquisition costs, and the development of all the related infrastructure.

The resort will occupy a 745,000-square-meter site. The casino alone will spread over 7,595 square meters. The mega-complex will also include two hotels that will occupy a total of 63,000 square meters.

Retail space at the resort will spread over 15,000 square meters, while leisure and live entertainment facilities will occupy more than 6,000 square meters. Plans include the development of a concert hall with capacity for 15,000 people.

Hard Rock plans to materialize the project in several phases. Phase One is estimated to cost the company about €700 million.

The gaming and hospitality company expects the scheme to create more than 11,500 construction and permanent, direct and indirect jobs and to generate about €1.3 billion in annual economic impact.

Aside from Spain, Hard Rock has also been looking to build an integrated resort at the site of a defunct airport near the Greek capital, Athens. The company was one of two bidders for the right to build such a property, but the Hellenic Gaming Commission disqualified it from the race early this year and picked the other contender – US-based gaming and hospitality operator Mohegan Gaming & Entertainment.

Hard Rock has appealed the regulator’s decision in Greek court and this week said that it is confident in the success of its legal motion.

Las Vegas casino joins the sneezeguard trend

Las Vegas casinos are all starting to make their plans for an eventual re-opening, whenever that may be. As many of the bigger resorts are publishing the safety guidelines they will follow when Governor Steve Sisolak allows gambling to resume, at least one downtown casino is following the lead of Penn National Gaming and hiring a local firm to install sneezeguards.las-vegas-casino-joins-the-sneezeguard-trend

Las Vegas-based Screaming Images, run by James Swanson, has started developing safety shields to install at table games and slot machines. The clear acrylic shields can be installed in 15 minutes, and would protect the players from each other, and the dealer, from unwanted airborne spray.

Downtown Las Vegas casino the El Cortez has already agreed to a trial run of these shields, allowing Screaming Images to install them in exchange for the free publicity they’ll get from it.

“James is really one of our best vendors by far. Very reliable and very responsive. He owns the company and yet he’s still one of the ones that comes out for a new project,” Adam Wiesberg, El Cortez general manager, told the Las Vegas Review-Journal. “So when he reached out about this new technology, and with everything being such an unknown to us and the industry, any new idea that could potentially work to protect employees and customers we’re willing to take a look at. So letting him use our tables and slot floor to create, design and develop this new technology, we welcomed it.”

Screaming Images isn’t a new company. The company has been in operation for 18 years, providing print and design services to resorts, as well as the Las Vegas Raiders, Golden Knights and the Aces.

These new dividers, Swanson noted, are made of clear acrylic and don’t fog up. They also don’t involve any screws, so they can easily be removed with no damage to the existing property, unlike the Penn guards which appear to be screwed right into the table. Wiesberg and others who’ve seen the setup have given it positive reviews, and a few hotel properties have already shown an interest in purchasing them for their floor.

It’s unclear at this point if the shields would help casinos lessen the need for social distancing; considering they aren’t bubbles, there’s probably still some need to keep players further apart. But if they help players feel safer, and reduce even some transmission of disease, they could be worth the investment.

And let’s face it, they aren’t the most elegant solution one could possibly imagine. But if they help casinos keep their customers safer, and allow the industry to get back in business faster, then they definitely suit a pressing need.
