The Colorado Limited Gaming Control Commission imposed the penalty because taking or placing bets for another person is illegal in Colorado. The sportsbook is operated out of Monarch Black Hawk Casino in Black Hawk, Co.

The bets were taken over the company’s sports betting app, BetMonarch. The company announced on Thursday that it would switch its geolocation provider from the current app provider, Stadium Solutions – a provider of sportsbetting platforms owned by Entain – to a near monopoly holder in the vertical in the United States, GeoComply.

According to an article found on CIOReview, a leading print and digital magazine for enterprise technology vendors & buyers, the State of Delaware also uses Stadium enterprise solutions but makes no mention of geolocation services. The review appears to claim that the company provides a platform to 17 of 21 sportsbetting host systems in Nevada.

Geolocation Not Usually so Easily Defeated

Geolocation services normally track the GPS location of a mobile phone and use other data such as nearby WiFi traffic to identify the phone’s location within a state’s boundaries with near absolute certainty. Proxy betting is one of if not the only ways to defeat the safeguards. Proxy betting is also used in land-based casinos, especially in Asia, to defeat travel restrictions as well as for unscrupulous actors to collect commissions on bets placed by high rollers from out of the area.

The breaches were purportedly discovered by the operator in June and self-reported to the regulator, resulting in the negotiated settlement.

The ensuing investigation found that more than $60,000 in wagers were placed for customers by three Monarch employees over about a year and a half spanning January 2021 through June 2022. Almost 80 bets were placed for 11 bettors in violation of the prohibition.

The company’s online sportsbook manager reportedly placed 60 of those bets after accessing the registered gamblers’ accounts. The manager and two other lead persons in the sportsbook division were suspended when the activity was discovered and later all three were fired.

Most of the bets came from players who were out of state at the time the bets were placed. Due to federal laws criminalizing interstate sports betting, geolocation services are critical to a provider’s compliance with state law as laws in every state are only passed to allow intra-state sportsbetting if operators can guarantee no out-of-state bets can be placed.

It’s unclear how the switch to GeoComply from Stadium will solve the problem going forward due to intellectual property rights and trade secrets. The Stadium system was defeated fairly easily and Geocomply may have other layers of security as it is a stand-alone solution whereas Stadium’s was part of an entire enterprise solution and management system.

System Didn’t Analyze Transactions Deeply Enough

However, the settlement agreement stated: “Stadium did not analyze geolocation transactions to detect the use of multiple device IDs and unrealistic location ‘jumping’ in order to identify potential proxy bets for out-of-state patrons.”

In the aforementioned CIO review, it stated that the “CEO of Stadium Solutions emphasized the complexity involved in creating [the]

holistic solution, with multiple validations to be performed even before a wager is taken while <sic> efficiently and accurately completed within milliseconds.”

In one case at Monarch, a patron in Florida contacted the sportsbook manager to help him place a bet and within minutes the gambler had sent his username and password to the manager in an SMS.

The bettor was able to make a deposit and within minutes a bet was made through his account. Investigators were able to determine that the manager placed the bet on his own work cellphone from within the state’s boundaries with the manager’s home address recorded via GPS at that time.

Several months later the same client sent the manager screenshots of the bets he wanted to place and nearly 50 bets were placed from within Colorado.

The settlement agreement stated: “Many of the screenshots displayed the time, which was two hours ahead of Mountain time, indicating [the patron]

was not in Colorado.”

The client was interviewed nearly a year later and admitted to officials that he was in Florida when the bets were placed. It’s unclear if any federal crimes are being investigated at this time.

Monarch received a $5,000 fine for each illegally placed bet as well as another fine of $5,000. The company has 10 days to pay half of the fine with the other half suspended for two years unless another violation occurs in that time.

Bally’s to Pursue iGaming in Home State of Rhode Island

Bally’s Corp. wants to open up online casino gambling in America’s smallest, yet most densely populated state. Officials announced on Wednesday that they intend to seek approval from the Rhode Island government to bring fully licensed and regulated online gambling to the state. Bally’s is headquartered in the state’s capital, Providence.

The proposal was announced Wednesday afternoon at a luncheon held by the Greater Providence Chamber of Commerce. Asking for legislative and executive branch approval during this year’s General Assembly session, the company said it would propose legislation to allow the RI Division of Lotteries to authorize online slot games and table games for players in the state.

Pending all approvals, the company hopes to start offering online gambling in Rhode Island by January 1, 2024.

After commissioning a study on the matter, the company said it believes that broader liberalization of gambling regulation in the state would give its two casinos – Bally’s Tiverton Casino & Hotel and Bally’s Twin River Lincoln Casino Resort a better chance to remain competitive in the long run. The games would be served from one or both locations.

Increased Gambling Revenue for the State

The new metric would also help the company deliver more revenue to state coffers.

We intend to model this after the legislation used to establish online sports betting in Rhode Island, effectively giving the State complete regulatory control and the ability to ensure the integrity of the program, while maximizing revenue for the State,” said Elizabeth Suever, Vice President of Government Relations for Bally’s Corporation. The state would be paid a percentage of all online gambling revenue generated by the site or sites.

The announcement came as a surprise to many as the company announced about three weeks ago that it would cut 15% of its North American interactive workforce. The announcement came in the form of a letter to Bally workers and a filing with the U.S. Securities and Exchange Commission.

More recently, Bally’s announced that CEO Lee Fenton would step down, and Robeson Reeves, President of Interactive would take his place. Both leaders came onto the company as part of Bally’s friendly acquisition of UK-based Gamesys for $2.7 Billion in 2021. That deal was announced in March and consummated in October 2021.

The company completed several other acquisitions in the meantime and now has 15 land-based casinos throughout the US and was recently given the approval to build the first casino ever in Chicago, IL., America’s third-largest city. Bally’s also holds sports betting licenses in 18 states.

Spectrum Gaming Study

Prior to beginning a discussion in the state to promote its idea of online gambling, Bally’s commissioned industry experts Spectrum Gaming Group to conduct a study of the matter.

Some of Bally’s claims based on that study include the following assertions:

Retail casino gaming would be preserved in the state with few or no players switching completely from land-based gambling to online slots and tables. (Bally’s operates the only two casinos in Rhode Island).

The state could potentially reap $210 million in gambling taxes over the first five years.

Gross gaming revenue is projected to be an estimated $93.3 million in the first year, increasing to an estimated $130.6 million annually in year five.

The proposed legislation would leave the state in control of all responsible gambling protocols, security, system integrity, accounting, and operating procedures. The state would also set conditions and terms for online table gaming and slots.

Players would need to confirm their age and identity to gamble online. Geolocation and other services would be employed to guarantee that a person was physically located within the state’s borders any time they placed a bet.

The physical servers that process and record the wagers would be located within a restricted, secure location on the casinos’ premises.

Xpoint Prevails as GeoComply Patent Infringement Suit Dismissed

xpoint_prevails_as_geocomply_patent_infringement_suit_dismissed_1A Federal District Court judge on Friday dismissed GeoComply’s patent infringement lawsuit against competitor Xpoint. Barring a successful appeal, the ruling by Judge William J. Bryson of the Delaware Circuit frees up one metric of the industry that has not had much competition as online gambling and sports betting explode state by state across the U.S.

The basis of the ruling is that GeoComply’s patent was never valid in the first place because it tries to patent subject matter that is not subject to patent law.

Geolocation services are critical for regulators and operators as it is the only currently accepted way of determining with a guaranteed high level of certainty where a player is located when they access a casino or sports book that is only allowed to operate within a state’s borders.

100 Million Geolocation Checks for Super Bowl

Once that is determined data collection and analysis can occur as well as was seen Monday when Geocomply announced that it had logged over 7.4 million account holders for Super Bowl Sunday and had completed over 100 million geolocation checks for sportsbooks, casinos, and regulators, logging a 25% increase over the previous year’s activity.

In the course of the lawsuit, Geocomply had asked the court for an injunction against Xpoint which would have prevented them from providing geolocation services until the litigation was concluded. Xpoint won a stay on that issue prior to Friday’s ruling.

GeoComply was forced to reveal its hand last month, indicating it had no first-hand evidence of patent infringement when it asked the court to compel a third party to provide evidence that Xpoint used “identical code processes” to GeoComply’s.

Part of a filing in the case stated: “Absent reviewing XPoint’s source code, it is not possible to articulate precisely how claim 1 of U.S. Patent No. 9,413,805 is met by XPoint’s accused geolocation service.

Chief executive officer of Xpoint, Marvin Sanderson commented on Friday’s ruling stating: “From the beginning of this litigation Xpoint has maintained that it has conducted its business legally and appropriately.”

The case was filed with the court late last year when GeoComply claimed that Xpoint had been violating its intellectual property rights by utilizing geolocation engine technology purportedly invented by GeoComply founders.

GeoComply asked for an injunction in September 2022 “to protect GeoComply’s investment-based risk” and to stop Xpoint from using the “invention”.

However, a quick once-over of the method, without direct access to the code, seems to show a process rather than a coded engine with multiple avenues to achieve the process.

In the initial lawsuit, it was stated by GeoComply thus:

A method for determining a geo-location, the method comprising:

transmitting a request to a first server by a first device;

collecting geolocation data associated with the first device in response to the request, the geolocation data collected by a module stored in memory and executed by a processor on the first device, the first device in communication with the first server which provides a service over a network;

identifying that one or more selected programs are present at the first device;

transmitting the geolocation data and programs and a list of the present selected programs to a second server;

receiving a geolocation message from the second server, the geolocation message generated at least in part from the geolocation data and a list of the present selected programs;

providing the received geolocation message to the first server.”

Xpoints response was that the suit was without merit.

A Monopoly Busted?

After the circuit court victory Friday, Sanderson commented: “As a company, we remained confident that we would prevail in this matter as GeoComply’s allegations were false, meritless, and a thinly veiled attempt to improperly maintain its monopoly on the gaming geolocation marketplace.”

GeoComply saw a greenfield advantage with the legalization of online casino gambling in the first states and took advantage of that to capture most of the market. The service is unique in that it essentially came about as a response to the need for it so by capturing the market, GeoComply may have inadvertently created a monopoly for itself with no fair and free competition.

To that thought, GeoComply had stated:

We welcome healthy competition and new ideas in the marketplace and the ability to distinguish our leading solutions and technology from others. We also respect and expect others to respect, the valuable intellectual property that companies like ours spend a lot of time, effort, and money developing. We are confident in the merits of our case.”

Massive Jump in Macau Bet Size During CNY

Some of the numbers draw direct comparisons between CNY 2019, the last pre-Covid tally, and CNY 2023 the first time the government has allowed free travel since the start of the pandemic.

The number of gamblers was not as high this year as it was in the same period in 2019, but according to a GGRAsia report on the gambling survey and analysis, the amount bet on each hand was “much higher” than in the previous period.

The surveys focused on premium mass gambling floors and mass gambling, rather than VIP rooms and junket tables.

One player observed in the survey reportedly bet about US$92,500 (HKD 725,000) on a baccarat bet at MGM Macau’s premium mass area.

Fat Stacks of Chips – Big Bets

In Cotai at Wynn Palace, Citigroup surveyors reported that one gambler was observed with “an approximately HKD 6-million chip stack in front of him, and he was betting HKD 300,000 a hand,” according to the report.

January 27th was the last day of the seven-day Chinese holiday marking the lunar new year and celebrated all over the world. However, most CNY celebrations outside of mainland China, Macau, and Hong Kong – which are special administrative districts of China – only saw local revelers as mainland Chinese failed to travel outside of areas administered by the Chinese government as citizens reorient themselves to a world without draconian health controls.

Government data counted nearly half a million visitors to Macau over the Chinese New Year week, nearly 3x as many as visited last year, but only about a third as many as in pre-pandemic 2019 CNY. The official numbers showed 451,047 visitors arrived throughout the so-called Golden Week, an increase year-on-year of 297%.

Gross gaming revenue in Macau reportedly swelled over 232% over the previous month with the explosion of travel, gambling, and revenues coinciding with the mainland government ending its zero-Covid policies.

Comparing the number of players observed in “premium mass” areas, the report indicated that just under 500 players were observed over the course of the week. That was a little more than half as many as were found around high-limit table games in the 2019 survey.

Fewer Players Betting More

While there were fewer players at the premium tables, the players were betting more this year than during the comparable period in early 2019. The 490 players observed over the week gambling at premium mass tables bet an average of just over $3,000 per hand (US$3082/HKD 24,178). The average bet was 45% higher this year than it was in 2019.

The obvious takeaway from those two topline observations is that player numbers were down, but higher-quality players visited the premium mass gaming areas in Macau for the holidays during this period.

Across the mass gaming floors of 15 major Macau casinos, the average minimum bet observed was about $285 (HKD 2,235), roughly in line with the average minimum bets of February 2019. While close to the value of 2019 bets, it’s important to note that this year’s numbers were up about 2% but only 1% shy of the record average minimum bet observed a few months before the 2019 survey period. Some hotels in Macau were sold out during CNY in 2019.
