Gambling Act Review White Paper a Year Later: What Is Done and What Are Plans for the Future

On April 27, 2023, the Gambling Act Review white paper was published in the UK, and everyone hoped it would be greatly helpful when it comes to gambling regulation. However, here’s what happened after one year.

Changes in the law

gambling_act_review_white_paperThe GB Gambling Commission discussed online and land-based casinos, as well as horse racing. The consultations about the Commission’s proposals began in July, and its main focus was promoting sustainable and safe gambling, as well as conducting affordability checks.

The discussion about the relationship between operators and players was one of the main topics. According to Victoria Reed, a Founder of Better Change, the standards are already high, and in order to develop more strict regulations, the balance is needed. She said: “This is already a heavily regulated industry so I would argue that standards are generally pretty high when compared with other industries. But the nature of our business is heavily influenced by technology and customer trends – therefore, there is never time to rest on our laurels and think we have got it all figured out.”

Matt Zarb-Cousin, Gamban’s co-founder and director of external affairs, is positive that operators will benefit from improving the relationship, and in order to do that, they would have to comply with a change of standards.

The sustainability and safety of gambling must be priorities, even from a preventive standpoint. Reed commented on that: “We see “safer gambling” very much as the practice of gambling safely. Therefore, the act of restricting, limiting, banning, blocking, and even stigmatizing gambling has no place in safer gambling. As a result of this, we see very little in the white paper that for us constitutes safer gambling – instead, we feel the measures such as stake limiting and financial risk checks are more aligned to player protection.”

Preventing problem gambling and major concerns

Better Change keeps supporting Positive Play and tries to prevent problem gambling before the issue occurs. Proposals from the white paper comply with that, but in order to work, they have to be carefully implemented.

The losses have to be limited since the players who lose more are at higher risk of becoming addicts, so setting the limits is one of the best ways to prevent it.

Even the operators would benefit from that, since if the customer loses all their money, they would have to be self-excluded and they would never get back. The Commission is ready to set up the affordability checks, but it will have to be done case-by-case in order to work. On top of that, a statutory levy on gross gambling yield will be imposed, and it will be 1%.

Zarb-Cousin commented on that: “Affordability checks, if they’re done properly, and the levy will make a big difference. The quantity and the resources that will be able to go into treatment and prevention campaigns – all of this will make a big difference.”

The main issue about the proposals from the white paper is funding. There are some funds donated for research, education, and treatment of problem gambling, but it seems the only way to get funds is a mandatory levy.

However, Zarb-Cousin hopes that the suggested changes can be implemented by October 2024, including the pilot program for affordability checks, which should be finished by then. Next year, the new levy system is supposed to be implemented, two years after the release of the white paper.

However, Melanie Ellis, a gambling regulatory lawyer and partner at Northridge Law LLP, is concerned that the new regulations could drive the players to illegal operators. She said: “There is a risk that some proposals, such as the stake limit for online slots and restrictions on bonuses and incentives, could lead to a significant increase in the number of customers turning to unlicensed operators, where they may not be offered tools to control their gambling or interventions if they display indicators of harm.”

However, it’s clear that the white paper increased the awareness of problems in the industry and was a significant step towards solving the majority of them. However, a lot of work is ahead of the UK regulators, and only years of hard work can result in complete change. Sustainability remains the main focus.

Ontario Regulator Stops Betting on World Boxing Association Events

ontario_halts_world_boxing_association_betting_over_integrity_concernsThe Alcohol and Gaming Commission of Ontario, the government body in charge of regulating sports betting and gambling in Canada’s most populous province, has ordered all licensed operators in the region to stop offering bets on events organized by the World Boxing Association (WBA).

The measure was due to concerns over the integrity of those events after the Alcohol and Gaming Commission of Ontario ruled that boxing matches organized by the WBA do not have adequate safeguards in place when it comes to preventing match fixing and insider betting. This all started after the regulator conducted a thorough review of the wagering activity of a title fight organized by the World Boxing Association.

The respective bout was the one between Yoenis Tellez and Livan Navarro, when the Ontario regulator observed suspicious betting patterns in live bets being placed over five and a half rounds during the match. The bout was observed by two registered independent monitors while the betting activity took place at a registered iGaming operator in the Canadian province.

There were also reports in the media claiming that the manager of Yoenis Tellez placed bets worth 110,000 dollars at a casino in Florida on the match going on for over five and a half rounds. The bet was a winning one as the match went on until the tenth round, when Tellez managed to knock out Navarro.

All Eyes on Insider Betting

The match took place in December 2023 in Florida and that is also when the Alcohol and Gaming Commission of Ontario started its review of the matter. One of the conclusions of the respective review was that bets related to boxing matches organized by the WBA don’t meet the current version of the Registrar’s Standards for Internet Gaming. This led to the indefinite suspension of betting on WBA events in Ontario.

The Alcohol and Gaming Commission of Ontario also underlined that its licensed operators were asked to demonstrate that the WBA prohibits betting from insiders and the respective operators were unable to do that. This means that coaches, managers, handlers or medical staff involved with one of the fighters could place bets on the respective matches while having the benefit of knowing non-public information. Moreover, the review found no proof that the World Boxing Association took any action to investigate past allegations of match fixing and insider wagering.

This is not the first time the Alcohol and Gaming Commission of Ontario takes such a measure. In December 2022 the regulator ordered licensed operators to stop offering bets on UFC (Ultimate Fighting Championship) matches following similar concerns over insider betting. That ban lasted just for a few weeks because the UFC then implemented new protocols to prevent insider betting.

VEGAS RESTAURANT ROUNDUP: Morgan Wallen Opening Ole Red Clone, Last Roundup for Holsteins at Cosmo

Looks like Blake Shelton will soon no longer be the only one in the country-star-opens-a-restaurant-and-bar-in-Nashville-and-then-Vegas business.

Morgan Wallen — called “the biggest country star of the 2020s” by the New York Times — is opening what is likely to be second location of This Bar and Tennessee Kitchen at a Las Vegas shopping mall, according to a Las Vegas Review-Journal report.

According to Wallen’s own website, the first This Bar is slated to open in Nashville this summer as a six-story, 30,000 square-foot bar, restaurant and live-music concept that sounds almost identical to the four story, 27,000-foot Ole Red, which Shelton opened in January at the Grand Bazaar Shops in front of Horseshoe Las Vegas.

Wallen’s second This Bar, according to the R-J, would only be 10,000 square feet and occupy the second and third floors of the 63 Las Vegas mall at the corner of Harmon Avenue and the Strip, atop of which sits Ocean Prime.

Wallen is partnering in This Bar with TC Restaurant Group.

The R-J story identified a building permit application that names only a $9.75 million “Vegas Country Music Restaurant” and a includes an “ellipse rooftop balcony” that connects to the restaurant.

Dining Ins & Outs

Holsteins, the burger restaurant that opened along with the Cosmopolitan in December 2010, will reportedly close this summer. This news comes from Casino.org’s own Vital Vegas blogger Scott Roeben, who reports it only as “a rumor” provided by an anonymous source.

That source seems to be fairly informed, since they also reported that the restaurant was a victim of a shakeup by new casino owner MGM Resorts, and that its former space will handed over to Clique Hospitality.

Last August, we reported that Bojangles — the franchise that expanded from its first location in Charlotte, NC in 1977 to 800 outlets across 15 states — is building 20 new restaurants in Las Vegas. It looks like the first will be at the Diamond Plaza retail center at the intersection of South Rainbow Boulevard and Blue Diamond Road, more than 10 miles southwest of The Strip. Bojangles operated as Bojangles’ Famous Chicken ’n Biscuits until 2020.

The El Herradero Nightclub, at 3402 E. Lake Mead Blvd. in North Las Vegas, was closed by the Southern Nevada Health District on April 17.
