Prairie Band Potawatomi Nation Becomes Illinois’ Only Recognized Tribe

The Prairie Band Potawatomi Nation has become Illinois’ only federally recognized tribe.

That’s after the U.S. Department of the Interior announced Friday it had placed 130 acres of land 70 miles west of Chicago into trust for the tribe. This is the process that converts land into a sovereign tribal reservation, partially removing it from the jurisdiction of the state, a prerequisite for Indian gaming.

The Prairie Band is headquartered near Mayetta, Kansas, where it operates the Prairie Band Resort and Casino but has ancestral ties to the land in Illinois.

The tribe believes that the land was illegally auctioned off 175 years ago, while Chief Shab-eh-nay was visiting relatives in Kansas.

Righting Wrongs

“Our federal government unlawfully sold the Prairie Band Potawatomi Nation’s land in Illinois,” said Prairie Band Chairman Joseph Rupnick, the fourth-generation great grandson of Chief Shab-eh-nay, in a statement. “The decision to put portions of the Shab-eh-nay Reservation into Trust is an important step to returning the land that is rightfully theirs.”

We have been asking for this recognition and for what is rightfully ours for nearly 200 years, and we are grateful to the U.S. Department of Interior for this significant step in the pursuit of justice for our people and ancestors,” Rupnick added.

The tribe did not say how it intended to use the land, other than it would “carefully evaluate” all possibilities. Back in 2016, shortly after the Prairie Band purchased the land, the tribe proposed a class II gaming facility, but it’s unclear if those plans will be revived.

Room for Another Casino?

A casino so close to the Chicago metropolitan area might be an attractive option. But Illinois’ gaming landscape has been transformed since 2016. In 2019, Gov. J.B. Pritzker (D) signed a gambling expansion package that would establish one big casino in Chicago and five smaller regional casinos in the southern suburbs. Another casino in the area could lead to saturation.

The tribe could operate class II gaming, such as electronic bingo and poker, under the Indian Gaming Regulatory Act without the permission of the state. A class III casino, with Las Vegas-style slots and table games, would require compact negotiations with the state.

A bill filed in the Illinois House of Representatives in February would give more land to the Prairie Band. But it contains a clause that would require the tribe to maintain the land as a public conservation area – which might rule out a future casino — or face a hefty fine from the federal government.

Washington State Casino Unprovoked Stabbing Leaves Man Dead

A suspect was apprehended Sunday morning after he allegedly fatally slashed a stranger inside Auburn, Wash.’s Muckleshoot Casino Resort.

The assailant and would-be victim didn’t know each other before the suspect snuck up to the victim from behind, while he was standing at a gaming table.

Random Attack

All of a sudden, the suspect stabbed him in the neck. Police are calling it a “random” attack. The victim passed away inside the gaming property.

No word on the victim’s identity. He was described as being in his late 20s.

Muckleshoot Casino staff immediately contacted the Auburn Police Department at about 1:30 a.m.

Officers arrested the unnamed suspect a short time later. He was booked at the King County Jail at about 8 a.m. Police said he will be charged with murder.

The suspect is 31 years old, according to Seattle TV station KCPQ. Police didn’t release a motive for the stabbing.

No one else in the Washington State gaming property was injured. It’s unclear how many guests or tribal casino employees were located near the victim when he was stabbed.

Stabbing Investigated

Police likely spoke to witnesses to the deadly attack. They also searched the crime scene for physical evidence. It’s possible detectives will review surveillance video to watch the activities of the suspect before he allegedly pulled out a weapon and stabbed the victim.

It’s likely the victim will undergo an autopsy to confirm the manner and form of death. Officials will also later describe the stab wounds and murder weapon used in the attack. The medical examiner’s office additionally will confirm the victim’s identity.

It’s unclear whether police seized a murder weapon from the crime scene.

They didn’t reveal whether it was a knife or other object. On the casino’s website, it clearly states, “Weapons, including firearms, are NOT ALLOWED in the casino or in the resort.”

Police didn’t explain how an object was snuck into the gaming room that could be used in such a fatal attack.

The casino is located about 16 miles east of Tacoma, Wash. The gaming property is operated by The Muckleshoot Indian Tribe.

Casino Expansion

Earlier this year, the casino held a ribbon-cutting for a major expansion. It includes 401 new guestrooms, an enlarged gaming floor, and a steakhouse located on the rooftop. The restaurant is called Smoke & Cedar.

An indoor heated pool will be opening soon, along with a hot tub and full-service bar.

Brazil Bans the Use of Credit Cards and Crypto for iGaming Payments

credit_cards_and_crypto_banned_under_brazil_payment_rulesBrazil, one of the largest regulated iGaming markets in the world, has set new rules which ban the use of credit cards and crypto currencies for payments related to gambling and sports betting.

The new rules were published by the Regulatory Policy of the Prizes and Betting Secretariat and the Ministry of Finance on 18 April in the national Official Diary of the Union, in the form of Normative Ordinance Number 615.

This new set of rules represents the beginning of the first stage of a four-part regulatory campaign that was presented last week by the country’s Ministry of Finance. This campaign will ultimately implement Bill 3,626, which was ratified by the Brazilian president in December 2023. The first stage is expected to be completed by the end of April and it will establish new rules regarding payments, technical aspects and security regulations.

Normative Ordinance Number 615 has established several new rules, with the first and most important being that iGaming operators in Brazil can no longer accept payments from credit cards, payments in crypto currencies or in cash. Moreover, payments in the form of payment slips or cheques are also prohibited.

All bets, withdrawals and payouts can be executed only through electronic transfers between the operators and their customers’ accounts. Moreover, the respective accounts have to be previously authorized by the Central Bank of Brazil. Operators will also have the obligation to deny payments from accounts not registered with the respective customer or from third parties.

Intermediaries between players and operators are strictly prohibited, but certain institutions authorized by the Central Bank are allowed to offer accounts on behalf of iGaming operators in some situations, for example to allow players to receive a prize that they won.

Winning Bets Paid Out in Less Than 2 Hours

Normative Ordinance Number 615 has also set a time limit for receiving prize payments on winning bets, operators must deliver that into the player’s account in at most 120 minutes.

The new rules also obligate operators to set up a virtual account for players in which they will be able to analyze details regarding their betting habits. This is expected to allow players to have a better understanding of their financial and betting information and make better decisions when it comes to managing their gameplay.

The respective virtual accounts will display the respective player’s betting history over the previous three years, with key aspects such as the total value of open bets and their financial balance on display.

Operators will also be in charge of managing their liquidity risk, including establishing a financial reserve of at least 5 million Brazilian Real, which would convert in around 950,000 U.S. dollars.

Wynn Las Vegas President Steve Weitman Leaving Company

Wynn Resorts (NASDAQ: WYNN) noted today Steve Weitman, the president of the operator’s Las Vegas Strip properties, is leaving the company effective June 10.

The executive didn’t give a reason for his departure beyond noting he’s evaluating other opportunities and now is “the right time to pursue my next chapter.”

After 20 years with this great company and leading the property to the best financial results in its history, Wynn Las Vegas and Encore are in an excellent operating position,” Weitman said in a letter to colleagues and staff at the Strip venues. “This has been an amazing journey and I could not be prouder to have worked alongside the best in the business. The friendships and relationships I’ve built with many of you over the last two decades will last a lifetime, for which I am most grateful.”

Wynn and Encore Las Vegas are the operator’s Sin City properties and two of its three US venues with the other being Encore Boston Harbor.

Weitman Had Long History with Wynn

When he leaves the gaming company on June 10, Weitman will have spent just over two decades with the firm.

He joined as senior vice president of Wynn Las Vegas — a role he held for 12 years and five months — in May 2004. In September 2016, he was promoted to chief operating officer (COO) of the Sin City venues. He occupied that role until January 2023 when he was elevated to president.

“All of us will miss Steve, but after such a long and successful run, we can all understand why he now wants some time to consider other life options. … Steve has been an integral part of Wynn Las Vegas for 20 years. He has demonstrated a singular level of dedication to Wynn and has contributed so much to our success. His career within the company has been inspiring to so many,” said Wynn CEO Craig Billings in a note to staff.

Prior to joining Wynn, Weitman spent more than eight years as director of operations and licensing for Walt Disney at that company’s Burbank, Calif. headquarters.

Interesting Timing for Weitman Departure

While neither Weitman nor Wynn gave a specific reason for the executive’s decision to leave the helm of Wynn Las Vegas, his departure comes as the operator is embroiled in litigation against Fontainebleau Las Vegas for pilfering Wynn staffers.

Wynn formally sued Fontainebleau in late February with the newest venue on the Strip firing back with a legal complain of its own less than a month later. Wynn believes that several former culinary and nightlife employees that jumped ship to Fontainebleau actively attempted to recruit former colleagues still employed at Wynn and some may have violated non-compete agreements with Wynn.

To be clear, there is no news at this point about Weitman moving to another casino or staying in the gaming industry following his June departure from Wynn Las Vegas.

Cayuga Nation Sues New York State Over Lottery Sales on Reservation

The Cayuga Nation is suing the New York State Gaming Commission (NYSGC) for selling lottery tickets on its reservation in the state’s Finger Lakes region.

The Nation asserts that by federal law it is the only entity authorized to regulate the conduct of gaming on its lands. That’s in a complaint filed Thursday in the U.S. District Court for the Northern District of New York.

Under the federal Indian Gaming Regulatory Act (IGRA), the state has no authority to offer gaming on the Cayuga’s sovereign reservation unless it is licensed to do so by the tribe, the lawsuit states.

Jackpocket App

Yet the state has deployed lottery terminals on the Cayuga reservation that dispense instant-win scratch-offs and tickets for draw games, according to the tribe. It has also issued a courier service license to Jackpot Inc, a company that enables users to play the New York Lotto and other NYSGC-licensed draw games via the Jackpocket mobile app.

Moreover, the Nation notes that lottery games are defined as class III gaming, akin to slot machines and roulette. The Cayuga themselves are prohibited from offering class III games on the reservation because they do not have a compact with the state.

Under IGRA, they can only offer class II gaming, such as electronic bingo and poker, at their four “Lakeside Entertainment” gaming venues.

The Nation has robust gaming operations throughout the reservation and uses the revenue to provide life-changing government benefits to Cayuga citizens,” said Cayuga representative Clint Halftown in an official statement. “New York State’s practice of authorizing lotteries on Reservation land causes grave concern to the Nation’s rights and ability to provide for Nation citizens.”

IGRA Trumps State Law

The Nation has already established in a federal court that “IGRA preempts all state and local legislation and regulation relating to gambling conducted on ‘Indian lands,’ as defined in that statute.” That ruling of July 2021 put paid to local attempts to thwart the tribe’s gaming operations.

The new lawsuit came after the Nation’s lawyers wrote to NYSGC and Jackpocket offering to discuss the lottery issue but received no response. The suit seeks declaratory judgment that the state is violating IGRA and an injunction to halt lottery terminals and Jackpocket’s operations on its lands.

“The Cayuga Nation has a responsibility to enforce its federally approved gaming ordinance and stop all unlawful gaming within the reservation, whether by the state or private individuals,” Halftown said. “The Cayuga Nation Council will not ignore the State’s gaming, especially the expansion to mobile gaming and the license to Jackpocket Inc.”
