Atlantic City Casino Smoking to Remain, as New Jersey Judge Dismisses Lawsuit

Atlantic City casino smoking will remain after a judge in New Jersey dismissed a lawsuit challenging the state’s permittance of tobacco use on the gaming floors.

New Jersey’s 2006 Smoke-Free Air Act banned indoor tobacco use in most indoor places other than private residences. The law provided some exemptions, with licensed casinos in Atlantic City being allowed to designate up to 25% of their gaming areas for tobacco use.

The United Auto Workers, which represents table game dealers, workers who are most exposed to secondhand smoke, and CEASE — Casino Employees Against Smoking’s Effects — challenged the 2006 law on the grounds that casino workers’ rights to personal health safety protections under the New Jersey Constitution were being violated. New Jersey Superior Court Judge Patrick Bartels disagreed in dismissing the claim.

“Because of the publicly known risks of secondhand smoke, that smoking has never been banned in casinos except for a short period during COVID-19, that the Smoke-Free Air Act’s exceptions only affect a few industries, and that the Smoke-Free Air Act does not hinder or affect a person’s ability to seek work in a smoke-free environment, it cannot be said that the New Jersey Legislature’s actions in providing exceptions to the Smoke-Free Air Act restricts the casino workers’ right to pursue safety under the New Jersey Constitution,” Bartels wrote in his opinion published Friday.

Each of the nine casinos in Atlantic City takes advantage of its smoking allowance. Critics say smoke knows no boundaries and dangerous, toxic secondhand smoke permeates the casino areas.

Odds Favor Appeal 

Attorney Nancy Erika Smith argued on behalf of CEASE and the UAW. She said an appeal to the New Jersey Supreme Court is forthcoming.

While the rest of the nation moves away from poisoning workers for profits, New Jersey shames itself,” Smith said. “As long as the governor, the legislature, and the courts allow the extremely rich casino industry to poison its workers, we will continue our fight.”

CEASE cofounder Lamont White said the “fight is far from over.” White hopes the court ruling will bring more enthusiasm to Trenton for state lawmakers to support bipartisan legislation to amend the Smoke-Free Air Act to rescind the casino smoking exemption.

Legislation last year in each legislative chamber had more than enough cosponsor support to force the casinos to go smoke-free. But Democratic leadership reportedly stalled the measures because of the November 2023 election where all 120 seats were on the ballot.

However, after retaining their majority in both chambers, the smoking bills still didn’t progress. Some of the 2023 support was subsequently lost after the casino industry, as well as a union that represents casino workers in nongaming roles, said a smoking ban would cost thousands of jobs and possibly result in a casino closing. 

Casinos Celebrate

For now, Bartels’ ruling is a win for the nine Atlantic City casinos. The retaining of smoking comes as Atlantic City’s casinos last week revealed that their operating profits slid nearly 2% in the second quarter despite increased revenue.

Commercial casinos/racinos operate in 28 states. Seventeen allow indoor smoking.

Nebraska Online Sports Betting Bill Advances, Odds Remain Long

Legislation to expand gambling in Nebraska to allow online sports betting advanced out of committee on Monday during the legislature’s special session.

The Unicameral General Affairs Committee passed LR3CA by a 5-2 vote on the 10th day of the special legislative session. Lawmakers were called back to the Lincoln capital by Gov. Jim Pillen (R) to come up with ways to reduce property taxes.

LR3CA is a proposed legislative referendum. For the 49 elected senators in Nebraska to authorize online sports betting, they must first gain electorate support to amend the state constitution to allow such gambling.

LR3CA seeks to ask Nebraskans during the November 5 presidential election if they wish to further expand gambling in the Cornhusker State. The gaming question would come four years after Nebraska voters approved three ballot referendums that legalized commercial casino gambling at horse racetracks and provided a regulatory framework for slot machines, table games, and in-person sports betting.

Referendum Bid Finds Support

LR3CA was filed by Sen. Eliot Bostar (D-Lincoln). Bostar says it’s time Nebraska reap the tax benefits of the many Nebraskans who are already betting on sports online, whether it be in neighboring states that offer legal, regulated internet sportsbooks or by gambling on illegal, offshore websites that cater to states that have limited gaming.

Bostar says allowing online sports betting and taking sportsbooks’ gross revenue at 20% would deliver Nebraska more than $30 million a year in new revenue. That money, his LR3CA proposes, could be directed to the Property Tax Credit Cash Fund.

During the committee’s deliberation of the referendum statute, General Affairs members voted to retain control over whether Nebraska becomes an online sports betting state upon a successful referendum. While Bostar’s initial draft sought to require the legislature to pass regulatory conditions to allow online sportsbooks should the public back the ballot question, the bill was reworked to allow — not require — the lawmaking body to authorize internet sportsbooks.

It keeps power in the hands of the legislature, allows voters to speak on it, and then lets the legislature decide,” said amendment sponsor Sen. John Cavanaugh (D-Omaha).

Under Nebraska’s current gaming laws, sports bets can only be made in person at one of the state’s brick-and-mortar commercial casinos.

Long Odds

Online sports betting’s forecasted $32 million a year tax windfall wouldn’t do much to offset the $5.3 billion in property taxes the state collected from property owners last year.

The legislature is instead focusing on avenues that could significantly help homeowners during the special session. Pillen has suggested that lawmakers send him bills that trim the state government’s spending and eliminate more than 100 tax exemptions that could generate $350 million annually for the state.

Online sports betting is expected to take a back seat, the Lincoln Journal Star reports. Unless lawmakers decide to act on the Bostar bill and it finds majority support in the chamber, Nebraskans won’t be asked about online sports betting until at least November 2026, as the state only permits statewide ballot referendums during even-numbered years.

Strive Gaming Remain Fully Focused on North American Markets

The company was founded just three years ago by Damian Xuereb, the current President, together with Max Meltzer, the current Chief Executive Officer. Xuereb says that the business had the advantage of understanding nuances of markets in each of the American states it operates in.

“We had the opportunity to do our research and ensure we built a product that meets not just the current state, but the future state or requirements, as and when we roll out into more and more states,” Damian Xuereb explained.

Another advantage for the company is that it refused to step into other markets away from the United States, keeping its focus solely on North America. “We won’t get distracted by other regulations,” Xuereb underlined, pointing out that the Brazilian, Dutch or German markets are not of interest for his company. “That means our business and our product will continually evolve around the North American player experience,” he added.

Eight Big Clients Secured

During its three years of activity, Strive Gaming secured partnerships with eight important iGaming brands. The first two were Desert Diamond and Golden Nugget Online Gaming in Arizona. Then the company signed agreements with Betsafe, PointsBet in Canada and Four Winds, owned by the Pokagon Band of Potawatomi Indians. The supplier has already secured additional clients which are yet to be announced.

About the company’s partners, Damian Xuereb said that all of them managed to “gain meaningful market share.” The Strive Gaming President gave the example of Desert Diamond in Arizona, which is owned by a local tribal operator, and revealed that the brand is successfully competing with “big hitters” and also triumphed against nationwide companies. “With the right technology behind a brand, local operators can compete,” Damian Xuereb concluded.

The Strive Gaming founder also predicted that there will be growing opportunities in North America because while online sports betting is currently present in 36 American states, iCasino is available in just seven states and the market is bound to expand. Indiana is one of the states where gambling legalization is discussed, while Joseph Addabbo, a state senator from New York, has introduced a new version of a bill which would legalize online casino gaming and internet lottery.

Casino Crime Roundup: Suspects Who Robbed Yonkers Casino Players Remain on the Lam

A man tailed two elderly women about a mile from Yonkers, NY’s Empire City Casino to their residence where they were robbed on Tuesday, police said.

The two women, one 83, the other 86, had just pulled into a driveway at a Valentine Street residence in Yonkers at about 3:30 p.m. They were just about to leave their car when the suspect approached.

He pulled out a firearm and stole their purses from inside the car, according to the Yonkers Daily Voice. He next fled down the driveway to a parked black Acura sedan, which sped away with an unidentified second suspect at the wheel.

Neither woman was injured, according to Yonkers police Detective Lt. Dean Politopoulos.

The suspect is a Black man in his late 20s or early 30s. He was dressed in a black baseball-style cap and a black T-shirt, and was wearing sunglasses.

Police continue to search for the suspect. If found, officers will likely apply for an arrest warrant that needs to be approved by a judge.

Drunk Casino Patrons Arrested in Pennsylvania

Two visitors to Pennsylvania’s Valley Forge Casino were apprehended at about 2 a.m. Sunday after one allegedly resisted arrest and the second allegedly helped him in his escape scheme.

The couple were both intoxicated and police tried to arrest one of them at the Upper Merion, Pa. gaming property.

The unnamed man appeared “unsteady on his feet,” Patch reported. He also began to argue with officers. Eventually, he allegedly tried to escape from custody when cops told him they were arresting him for public drunkenness.

At that point, the unnamed woman attempted to help him resist the officers, police said.

Eventually, both the man and woman were arrested and transported to Upper Merion Police Station. They were charged with resisting arrest, public drunkenness, and other counts.

TV Damaged by Illinois Casino Visitor

A man was apprehended on Thursday after he allegedly punched an LED flat-screen TV at Harrah’s Casino in Joliet, Ill.

Joliet cops arrested Antonio Valdez, 33, of Harvey, Ill., and charged him with criminal damage to property before booking him at the Will County Jail.

Casino security guards initially ordered Valdez to leave the gaming property due to his intoxication. He started to make his way to the casino’s parking garage when, on the way, he allegedly punched the TV in a hallway.

Valdez returned to the gaming property where he was apprehended by security guards. He was later turned over to local police.

Valdez punched the TV so hard, it broke, Punch reported. Its replacement value is about $700. He wasn’t injured from when his hand struck the television.

Titus, Reschenthaler Remain Co-Chairs of Congressional Gaming Caucus

The leaders of the Congressional Gaming Caucus will continue in their roles for the next two years.

On Monday, US Reps Dina Titus, D-Nev., and Guy Reschenthaler, R-Pa., announced they would again serve as co-chairs of the bipartisan group that seeks to inform their colleagues in the House about important gaming issues.

Gaming is now widespread across the country thanks to the expansion of legal sports betting. Some form of gaming is now legal in 44 states, and sports betting is now available in 33 states plus the District of Columbia. According to the American Gaming Association (AGA) home to 146 million adults – more than half the adult population in the US.

In addition, 163 of the country’s 435 congressional districts, or 37.5%, have at least one casino.

Leaders Vow to Work Together

Titus’ district includes nearly all of the Las Vegas Strip.

Las Vegas’s gaming industry has set the national gold standard, which has been followed across the country as gaming has expanded,” she said. “As co-chair of the Congressional Gaming Caucus, I look forward to working with Rep. Reschenthaler and our colleagues in a bipartisan way to help well-regulated gaming markets flourish and incentivize economic development in District One and across the country.”

Reschenthaler, whose district covers parts of Southwestern Pennsylvania, noted the gaming industry is coming off a strong year fueled by record-breaking revenue totals.

“I am proud to lead the Congressional Gaming Caucus alongside Rep. Titus to strengthen policies on Capitol Hill to create good-paying jobs, drive economic development, and increase investments in districts across our nation,” he said.

Taxes, Illegal Gambling Key Priorities

Titus and Reschenthaler’s joint release noted three gaming issues the caucus prioritized for the two-year session.

The caucus wants to eliminate what the co-chairs called “discriminatory” taxes, which would include the .25% federal excise tax on legal sports bets that has been around since the 1950s. The tax, along with a $50 per employee fee licensed sportsbooks must pay, is seen as a barrier for legal operators that are trying to win customers from illegal or unlicensed operators.

Another key item for the caucus will be raising the slot tax threshold. It’s been 46 years since the threshold was last raised, and caucus members have previously pushed for the current $1,200 limit to be increased to $5,000.

Caucus members and the AGA have said that the low threshold has led to a sharp uptick in reportable jackpots. That increase has led to more work for casinos, which must shut down the winning slot machine each time as a casino employee prepares a tax form for the winning bettor.

And the caucus also wants to see the federal government do more to end illegal gaming operations that cost states billions in tax revenues.

“The AGA and our members look forward to working with the caucus and new Congress to ensure sensible tax policy and combat predatory, illegal gambling,” AGA President and CEO Bill Miller said in a statement. “These issues are critical to a thriving industry and when gaming thrives, so do communities in 44 states across the country.”
