Minnesota’s Running Aces Racino Adds More Casinos to RICO Suit

Minnesota harness racing track Running Aces has added two more casinos to a federal racketeering suit that claims tribal operators in the state are running “illegal” games.

Last month, the Columbus, Minn.-based racino sued the Grand Casino Hinckley, Grand Casino Mille Lacs, and Treasure Island Resort. Running Aces claims they conduct class III card games that are not covered by their tribal-state gaming compacts, such as Three Card Poker and Ultimate Texas Hold’Em.

The Grand Casinos are owned by the Mille Lacs Band of Ojibwe. Treasure Island belongs to the Prairie Island Indian Community.

In an amended complaint filed Tuesday, Running Aces added Mystic Lake and Little Six Casinos, which are owned by the Shakopee Mdewakanton Sioux Community (SMSC).

‘IGRA Violated’

The racino accuses all five casinos of violating the Indian Gaming Regulatory Act (IGRA), as well as state laws, by operating not only class III card games but also “video games of chance,” such as slots.

The tribes are permitted by the state to offer these games under the terms of their compacts. Minnesota was the first state to sign compacts with its federally recognized tribes after the enactment of IGRA in 1988.

Many feel lawmakers blundered by failing to negotiate revenue-sharing provisions. The state is not permitted to renegotiate any of these compacts without the tribes’ approval.

But the Minnesota criminal code “specifically prohibits and makes illegal the playing of electronic video games of chance for any person,” as the lawsuit notes.

This is something the tribes “know only too well,” per the lawsuit. When Running Aces applied to Minnesota Racing Commission to “modestly expand its ‘dealer assist’ table games,” the SMSC objected on the grounds that “video games of chance are not permitted in Minnesota,” the suit states.

‘No Merit’

“All that we have ever sought was to be treated fairly, compete on a level playing field, take advantage of improvements within the pari-mutuel environment, and operate without fear of being eliminated,” Running Aces president and CEO Taro Ito said in a statement to local CBS affiliate KSTP-TV. “It is our sincere desire to have our day in court and let the facts determine the outcome.”

But the SMSC dismissed the Running Aces lawsuit as having “no merit,” labeling it a “desperate stunt to attack the good reputation of tribes and tribal gaming” in a statement to FOX 9.

The SMSC claims Running Aces is seeking to “mislead the public and influence the final stages of the Minnesota Legislature’s 2024 session,” to prevent the passage of a bill that would hand a sports betting monopoly to the tribes.

Dr. Miriam Adelson, the largest individual shareholder of the Las Vegas Sands casino empire she inherited from her late husband, has made her first political donation in nearly two years. But the cash didn’t go directly to Donald Trump, the former president whose 2016 and 2020 White House campaigns she and her husband, Sheldon Adelson, dumped more than $200 million into.

Adelson controls 46% of the Sands organization following her $2 billion stock sell-off last year to acquire a controlling ownership position in the NBA Dallas Mavericks. Adelson, a stalwart Republican and perhaps the strongest pro-Israel voice in the United States, remained politically active in 2022 after the January 2021 death of her husband.

Adelson gave $1 million to Texas Gov. Greg Abbott’s (R) reelection in 2022, a contribution many saw as an effort to win political favor for the state welcoming in commercial casinos. She also gave $20 million to GOP congressional committees that year.

Adelson’s political spending went quiet throughout 2023. But federal campaign finance records show that Adelson, who’s worth more than $30 billion, might be returning to the political arena ahead of the November 2024 presidential election.

PAC Money

Before 2024, Adelson’s last political donation was an $8,100 contribution in November 2022 to a California Republican’s Attorney General campaign. Records from the Federal Election Commission reveal that Adelson reopened her political treasure chest in March with a $5,000 donation to the Las Vegas Sands Political Action Committee (Sands PAC).

The Sands PAC predominantly supports Republican candidates both on the federal and state level. The PAC limits its contributions to a maximum of $5,000 per candidate.

Adelson pitching in $5,000 is rather uneventful, but it could hint that the billionaire is readying to ramp up her political spending. Adelson said during the 2024 GOP primary that she wouldn’t endorse or financially support a candidate in favor of allowing the Republican electorate to decide who should challenge President Joe Biden.

The primary is long over, yet Adelson hasn’t contributed to Trump’s 2024 campaign. He needs cash, as the costly lawsuits against him play out.

Adelson and her husband poured more than $524 million into Republican campaigns and PACs between 2011 and 2022.

Biden Outpacing Trump

According to the FEC, Biden has significantly more cash on hand than Trump. The incumbent has around $130.8 million in funds to spend on his 2024 campaign, while Trump is said to have around $66.7 million.

Adelson, of course, can singlehandedly push Trump above Biden, assuming the Democrats’ largest donors, including George Soros and Michael Bloomberg, don’t do the same with hefty donations to the president.

Trump will be without the support of Americans for Prosperity, the super PAC controlled by the Koch network. The group backed Nikki Haley during the 2024 GOP presidential primary. The Koch network is controlled by Charles Koch, one of the world’s richest individuals who has long been a Republican supporter, but a Trump foe.

MGM Will Be Held to Host City Agreement in Possible Springfield Casino Sale, Say Officials

Nearly two months ago, reports surfaced that MGM Resorts International (NYSE: MGM) is mulling the sale of its regional casinos in Ohio and Springfield, Mass. Officials in the Massachusetts city said they intend to hold the gaming company to the terms of the host city agreement should a transaction materialize.

In March, it was reported that MGM could be evaluating the sale of MGM Springfield and MGM Northfield, a racino near Cleveland. MGM Springfield opened in August 2018 as the first traditional casino in Massachusetts. That venue, which generated $278 million in sales in 2023, hasn’t lived up to the operator’s expectations.

In a recent interview with Western Mass News, Springfield City Council President Michael Fenton, who also chairs the casino oversight committee, said MGM cannot unilaterally decide to leave the city.

I don’t think the public should be concerned because we have safeguards at the city and state level to make sure there’s no unilateral movement by MGM,” Fenton told the media outlet. “MGM doesn’t have the right to decide to move out on their own.”

The Massachusetts venue cost the operator $960 million to build. MGM sold the real estate assets to MGM Growth Properties (MGP) for $400 million in 2021. VICI Properties (NYSE: VICI) acquired MGP for $17.2 billion that same year, gaining control of the property assets of MGM Northfield Park and the Springfield casino, among other MGM venues.

How MGM Can Do Right by Springfield

While MGM has acknowledged that the Massachusetts and Ohio casinos haven’t lived up to expectations, it hasn’t publicly confirmed it’s shopping those venues. The topic wasn’t addressed on the operator’s first-quarter earnings conference call earlier this month.

The obvious avenue through which MGM can assuage Springfield’s concerns about a possible sale of the casino is to line up a buyer from the gaming industry, which would be likely assuming the operator is looking to sell. That’s also important because the property is zoned to be a gaming venue.

As for potential buyers for MGM Springfield’s operating rights, names haven’t been floated, but it’s probably fair to rule out Penn Entertainment (NASDAQ: PENN) because it runs  Plainridge Park Casino in Massachusetts.

It’s possible that tribal gaming entities in New England could be interested in MGM Springfield, but for now, that’s just speculation.

Springfield Wants ‘Same Pedigree’ as MGM

Fenton told Western Mass News that should MGM opt to depart Springfield, the city will require that the replacement operator be of the “same pedigree” as MGM. That’s a subjective term, but there are some hard details.

Under the host city agreement, MGM is required to deliver $25 million in annual payments to various groups in the city and book at least 12 acts per year at entertainment venues near the casino. Fenton said a new gaming operator of the Springfield casino would be held to the same standards.

A transaction involving MGM Springfield materializing over the near term is a possibility, but analysts believe gaming industry mergers and acquisitions are currently hamstrung due to high interest rates. That implies prospective suitors that need financing to buy the operating rights to the venue might be put off and eschew bidding, thus dwindling the pool of potential buyers to those that can pay in cash.
