Court Voids Nassau Coliseum Lease Transfer for Sands New York Casino Plan

A New York State Supreme Court justice Thursday annulled a previously agreed to lease transfer of Nassau Veterans Memorial Coliseum in Uniondale, NY — the site where Las Vegas Sands is looking to construct a $4 billion casino hotel.

In May, the Republican-controlled Nassau County legislators voted 17-1 in favor of granting Sands a 99-year lease to develop county-owned land on the Nassau Hub site. Sands revealed in January that its quest for a New York City-area gaming license would be centered on Nassau County. This year, Sands has paid $241 million to the former lease holder, Nassau Live Center LLC, as well as $54 million to the county as required by the lease accord.

Sands’ effort to procure one of the three yet-to-be-awarded New York City-area casino permits is widely supported by Nassau County politicians of both parties and the plan is mostly favored by vocals, but Hofstra University is a vocal critic of the proposal.

In April, the university, which is located near the Coliseum, sued Nassau County, alleging county officials held talks on the Sands casino without informing the public of those discussions. If true, that violates New York’s open meeting laws.

Hofstra has demonstrated that the failure to post the resolution was not merely technical, but rather was ‘an attempt to avoid public scrutiny’ of the proposed lease transfer,” wrote Justice Sarika Kapoor in her decision.

Sands said the ruling doesn’t affect its New York plans nor does it believe the decision will impact its odds of winning a gaming permit in the state.

Nassau County Has Some Work to Do

In her ruling, Kapoor asserted that Nassau County focused more on the technicalities of the Coliseum lease transfer to Sands and less on allowing public comment on the issue and how a gaming venue could affect nearby communities.

Sands has touted the job-creating potential of the proposed gaming venue and its ability to bolster receipts for Nassau County and the state. The company has also highlighted plans to lure convention business to the hotel, entertainment and restaurants — traits that diminish the argument that it would be a gaming-centric establishment.

However, the Say NO to the Casino Civic Association, a group opposing the Nassau County casino effort, argued that not only have locals not had their voices heard, but a gaming venue could increase crime, environmental harm and traffic. The group is calling for environmental and traffic impact studies to be conducted following the Supreme Court ruling.

In her decision, Kapoor noted because the county “engaged in improper segmentation by not considering the future development planned by Sands, the Court finds that the Nassau County Legislature did not take the requisite ‘hard look’ at the relevant areas of environmental concern raised by the lease transfer…”

A traffic study has yet to be conducted, and Sands chose to focus its New York efforts on Long Island to avoid contributing to motor vehicle congestion in Manhattan. In August, Sands submitted a land-use application to Hempstead — one of the towns that could be affected by the casino hotel — and that town is conducting an environmental impact review as required by state law.

Ruling Adds to Already Chaotic New York Casino Process

In 2022, New York lawmakers approved three downstate casinos — a decision that has lured some of the industry’s biggest names to the fourth-largest state to try their luck. Since then, the process has become increasingly hectic.

It was originally expected that regulators there would decide on the three winning bidders in 2024, but some analysts believe that decision will be pushed off to 2025. Additionally, bids by MGM’s Empire City Casino in Yonkers and Genting’s Resorts World New York in Queens could be hampered by former executive Scott Sibella’s alleged role in an illegal sports betting ring.

Thursday’s court ruling on the Nassau County lease transfer adds to the chaos. The Say NO to Casino Civic Association views the decision as a warning shot for other New York casino efforts.

“New York State officials should take note of this ruling by Judge Kapoor when making decisions on awarding the gambling licenses, as it highlights (Nassau) County Executive (Bruce) Blakeman’s contempt for his own constituents, and his blatant disregard for federal, state, and even county laws, as well as the right of every Nassau County resident to understand the wide-ranging, long-term impacts that this massive project will have on our way of life,” according to the group.

Illinois Gaming Board Approves Three Casino Licenses

illinois-approves-casino-licenses-as-dgc-drops-online-wagering-bidThe Illinois Gaming Board, the government body responsible for regulating gambling in the American state, has announced that three land-based casinos have received licenses to operate in Danville, Carterville and Chicago.

Moreover, at the meeting of the Illinois Gaming Board in the last week of October, the Argosy Casino Alton was granted an extension on its already existing license so it will continue to operate for another four years.

The casinos that received the three licenses are Golden Nugget Danville, Walker’s Bluff Casino Resort and Bally’s Chicago. The license applications were put to the vote of the Board, but before that each of the casino representatives was given the chance to present the highlights of their operations and the future plans.

Along with the license for Bally’s Chicago, the company that operates that casino also received approval to operate a temporary casino at Medinah Temple for a total of 36 months while its permanent venue is under construction in Chicago.

Marcus D. Fruchter, the Administrator of the Illinois Gaming Board, made a quick recap following the meeting and underlined that the Board has licensed five new casinos since November 2021, with the respective venues located in Rockford, Waukegan, Danville, Carterville and Chicago.

The Illinois Gaming Board Administrator described this period as one “of unprecedented growth and expansion” and reminded the public that the government body remains “steadfast in its commitment to ensuring the ethics, compliance, integrity, safety, and transparency of Illinois gaming.”

New Video Gaming Rule

Marcus D. Fruchter also announced that the Joint Committee on Administrative Rules has adopted Video Gaming Rule 1800.1750, which had previously been adopted by the Illinois Gaming Board in April 2023. The new rule requires all operators licensed in Illinois to post responsible gaming signage in all video gaming locations. Casinos and sportsbooks were already required to do this in Illinois.

The Illinois Gaming Board also announced that it has completed a study on undue economic concentration in the video gaming industry in the American state. The respective study was completed by Christiansen Capital Advisors and its findings will be used by the Board to refine and adapt its regulations in order to keep the gaming market in Illinois innovative and competitive.

“Complex and important issues surrounding undue economic concentration have been largely unresolved since passage of the Video Gaming Act in 2009, and this study is an important step for the IGB’s work in this space,” Marcus D. Fruchter explained.

Light & Wonder Launches Live Casino Content from Authentic Gaming in Michigan

The content will be available through the BetRivers brand, which is owned and operated by Rush Street Interactive. Light & Wonder did not have a presence on the live casino market before the acquisition of Authentic Gaming, which took place in November 2021.

Authentic Gaming continued to operate under its own brand after the acquisition and it will deliver live dealer games to BetRivers from a brand new studio it has purposely built in Michigan. The new live casino studio is ready to offer bespoke environments for individual operators, so it is likely that the supplier will sign partnerships with other brands in the state in the coming months.

The initial deal between Authentic Gaming and Rush Street Interactive contains just five live casino titles: Premium Blackjack, Stadium Blackjack, Premium Roulette, Premium Baccarat and All Michigan Auto Roulette. However, the supplier mentioned that “further releases are being planned for the future.”

A Premium Offering

Speaking about the company’s live casino offering, Jonas Delin, the founder of Authentic Gaming, described it as “premium” and expressed his belief that players across the United States will “resonate strongly” with the supplier’s content.

“This launch represents a key stage in our growth journey,” Jonas Delin added. The founder of Authentic Gaming also said that the company’s studio and live casino offering “will have a major impact on the online casino market across the United States.”

Richard Schwartz, the Chief Executive Officer of Rush Street Interactive, said that the products provided by Light & Wonder and Authentic Gaming create “next-level experiences” for players. Moreover, the Rush Street Interactive CEO said that “Authentic Gaming has created a compelling array of content that speaks directly to the preferences of players in Michigan.”

Authentic Gaming started out back in 2015 with only 3 employees and in just a couple of years it managed to build a team of more than 30 developers and sign partnerships with major online casino brands such as Mr Green, Nyx Group, Leo Vegas, Bethard Group and EveryMatrix.

Casino Crime Roundup: Rapid City Casino Robbed at Knifepoint

Rapid City, S.D. police officers are continuing to search for the knife-wielding bandit who robbed a local gaming property on Wednesday.

The brazen holdup took place at 777 Casino on West Main Street at about 8 a.m., according to Rapid City TV station KNBN.

The sole robber ordered a casino employee to turn over money. The worker gave him the cash and the suspect fled.

The suspect was believed to be Hispanic or Native American and about 5’4″ tall. He was wearing a red, white, and blue mask, a grey sweatshirt, and dark pants.

Police didn’t reveal how much money was stolen and no one was injured during the robbery.

Late this week, police have yet to identify a suspect

The same casino has been previously robbed, including one holdup that took place last Christmas Eve. That suspect fled with an undetermined amount of cash.

Shooting Near Oklahoma Casino

A fight between brothers led to shots being fired outside of the Gold Mountain Casino in Ardmore, Okla. on Tuesday morning.

Ten officers from the Chickasaw Nation Lighthorse Police Department responded to the Oklahoma crime scene, according to Texas TV station KXII.

No one was injured during the struggle and confrontation.

An unnamed suspect was apprehended by police, who also seized a firearm.

A nearby educational institution, Southern Tech, was placed in lockdown while the incident unfolded. The casino apparently remained open during the incident.

Illegal Gambling Leads to Five Arrests

Five suspects were arraigned in court recently after numerous gaming machines were seized during raids of storefront operations last year in Michigan.

The Michigan Gaming Control Board (MGCB) revealed the arrests after investigations into activities at The State Road Spot in Davison, Mich., and The Bristol Spot in Burton, Mich. Both are located in Genesee County.

Authorities seized 100 illegal gambling devices during the raids. Also seized was more than $29K in cash and 62 gift cards.

The Davison gambling den had 65 gaming devices, including 54 computer towers and 11 gambling machines. The Burton gambling den had 23 computer towers along with 12 gambling machines and other devices.

The raids both took place on April 27, 2022

Two suspects, Joseph Toporek and Mary Larkin, each are facing eight charges. They include:

  • Three counts of running a gambling operation without a license
  • Three counts of using computers to commit a crime
  • Maintaining a gambling house for gain
  • Keeping a gambling house

The other suspects, Shaun Bellah Sr., Shaun Bellah II, and Ghazwan Brikho, are each facing 10 charges, including:

  • Five counts of conducting a criminal enterprise
  • Conspiracy to conduct a criminal enterprise
  • Running a gambling operation without a license
  • Using computers to commit a crime
  • Maintaining a gambling house for gain
  • Keeping a gambling house

Each of the suspects was arraigned during August and September in Genesee County District Court. The suspects were released from custody on personal recognizance bonds.

The investigation was launched after the MGCB received a tip about illegal activity going on in Burton. Officials learned about gambling going on in the second location as part of the continuing investigation.

Accountability is crucial when it comes to upholding justice and ensuring a fair and honest gaming environment in the state of Michigan,” MGCB Executive Director Henry Williams said in a recent statement.

“While the Michigan Gaming Control Board will continue to hold those who choose to circumvent the law accountable for their actions, we also acknowledge the importance of fairness, equality, and the presumption of innocence until proven otherwise.”
